In April 1913, at age 75, he was appointed Warden of Kingston Penitentiary, but appears to have not actually arrived in Kingston until August. Later in 1913, he was elected Vice-President of the American Corrections Association for a one-year term. He served as Warden for one year, retiring from the public service in August of 1914.
Warden Irvine died in Quebec on January 9, 1916.
